The court granted class certification on August 3, 2023 and preliminarily approved the $43 million settlement on February 18, 2025. New York drivers should look at the separate $48M Volino v. Who Was Eligible?

The settlement classes were defined by Progressive's own claim records. Eligible class members included:

• Georgia residents who made a first-party total-loss claim on a Progressive Mountain Insurance Company policy between October 11, 2015 and February 18, 2025.

• Georgia residents who made a first-party total-loss claim on a Progressive Premier Insurance Company of Illinois policy issued in Georgia between June 8, 2016 and February 18, 2025.

In each case, the claim had to be one in which Progressive applied a Projected Sold Adjustment to comparable vehicles when calculating actual cash value.

How Much Did Class Members Get?

Each eligible class member received a pro rata share of the $43,000,000 fund after court-approved fees and expenses (about $28,030,667 was allocated to class members). The average payment was estimated at roughly $173, though individual amounts varied based on each underlying total-loss claim file.

How Payments Were Sent

No claim form was required. Notices were mailed to all eligible class members on March 31, 2025 with each recipient's estimated award amount.
