What Was the Case About?
East River Medical Imaging, P.C. is a radiology provider with locations in New York City and Westchester County. According to the notices issued in the case, an unauthorized user accessed files on the practice's systems between August 31, 2023 and September 20, 2023 and copied data from the network. Reporting on the incident placed the number of affected individuals above 500,000.Plaintiffs alleged that the practice failed to adequately protect patient information and that the exposed data included Social Security numbers, names, contact details, insurance information, referring-physician details, and exam, procedure and imaging results. The practice denied wrongdoing and agreed to the settlement to resolve the claims without any admission of liability.
Who Was Covered?
The settlement class covered United States residents whose personal information was involved in the data security incident that East River Medical Imaging disclosed in or about November 2023. People who received a mailed notice from the settlement administrator were identified as class members.What Benefits Were Available?
Class members could claim reimbursement of up to $7,500 for documented losses that were more likely than not traceable to the incident, such as bank fees, professional-service costs, communication charges and credit-related costs. In place of a documented-loss claim, a class member could elect a pro rata cash payment from the fund, with the per-person amount depending on how many valid claims were approved after fees, costs and administration were deducted.
