What Was the Case About?

Botanic Tonics, LLC, which makes and sells the feel free wellness tonic, agreed to an $8.75 million settlement resolving allegations that it marketed and sold the kratom-containing beverage without adequately disclosing the ingredient or warning consumers about the potential health risks associated with it. Botanic Tonics denies any misconduct and agreed to settle to avoid the cost and uncertainty of continued litigation.

Kratom is a plant-derived substance often sold as a supplement and promoted for energy, mood, pain relief or easing opioid withdrawal. The U.S. Food and Drug Administration has not approved kratom for any medical use and has raised safety concerns, and the National Institute on Drug Abuse notes that it can produce opioid- and stimulant-like effects and that its use can lead to addiction. Some states restrict or prohibit its sale.

How Much Could Claimants Get?

Approved claims were valued at a minimum of $10 per bottle, with the final amount set on a pro rata basis that depended both on how many bottles a claimant purchased and on the total number of valid claims submitted against the $8.75 million fund. Because per-person amounts scale with bottle count and total participation, no single figure applies to every claimant.

• Claims for 10 bottles or fewer could be submitted without proof of purchase.
• Claims for more than 10 bottles required documentation, such as receipts, for each purchase.

What Proof Was Required?

This page is marked Proof Required: Yes. Filing online used a login and password supplied in the mailed or emailed notice — an administrator-issued credential — and claimants who never received a notice had to register with the administrator to obtain one before they could access the claim form. Separately, any claim above 10 bottles required receipts or comparable documentation. The no-receipts tier for 10 bottles or fewer did not remove the credential requirement for online filing.

What Happens Next?

With final approval entered on October 20, 2025, the remaining steps are the resolution of any appeal and the administrator's distribution of the net fund to approved claimants.
