What Was the Case About?

The U.S. Equal Employment Opportunity Commission sued Focus Plumbing, LLC and related entities, alleging that since 2017 the companies subjected a class of monolingual Spanish-speaking female employees to a hostile work environment and quid pro quo sexual harassment. According to the EEOC's complaint, the conduct included unwanted touching and groping, sexual advances, and sexually offensive comments and requests. The EEOC further alleged that employees were threatened if they rejected advances, while others were offered better work assignments and hours if they acquiesced.

These are the allegations the EEOC made in its lawsuit. The case was resolved by consent decree rather than by a trial verdict on those allegations.

Who Was Covered?

The claims process covered women who worked at Focus Plumbing from October 2017 onward and who were subjected to the harassment described in the EEOC's suit. Eligible individuals had to complete and return the claim questionnaire — online or by mail — by October 1, 2024 to be considered.

What Did the Settlement Provide?

Focus Plumbing, LLC agreed to pay $500,000. Together with Focus Electric, LLC, Focus Concrete, LLC, Focus Fire Protection, LLC and Focus Framing, Door & Trim, LLC, the company also agreed to comprehensive injunctive relief, including:

• Specialized sexual harassment training for human resources officers and managers, covering their obligations to prevent harassment and how to handle complaints.
• Posting a notice about the lawsuit in the workplace.
• Hiring an external equal employment opportunity monitor.

The decree remains under the court's jurisdiction for two and a half years. Individual monetary awards were determined by the EEOC based on the information each claimant provided in the questionnaire; no fixed per-person figure was published.

Opening the claim questionnaire required the CPT ID and passcode sent by postcard, notice or email. What Is the EEOC?

The Equal Employment Opportunity Commission is the federal agency that enforces laws against workplace discrimination. Established under the Civil Rights Act of 1964, it investigates complaints of discrimination based on race, color, religion, sex — including sexual orientation and gender identity — national origin, age, disability and genetic information, and can sue employers on behalf of affected workers, as it did here.

What Happens Next?

Monetary distribution to claimants was handled by the EEOC following the questionnaire deadline. The remaining obligations are the injunctive terms of the consent decree, which run for its two-and-a-half-year term under court supervision. No further claims process is expected.
