Google Assistant Privacy Settlement — $68 Million for Google Home, Nest, and Pixel Owners

If you own a Google Home, Google Home Mini, Google Home Max, Google Nest Hub, Google Nest Hub Max, or a Google Pixel smartphone, this settlement could mean money in your pocket. And if Google Assistant ever activated on your device when you did not say "OK Google" or "Hey Google" -- recording a private conversation you never intended to share -- the payout could be even larger.
The lawsuit alleges that Google Assistant does not just listen when you ask it to. It allegedly activates and records audio even when nobody says the trigger words. These unintended activations are called "false accepts," and the lawsuit claims they happened far more often than Google let on. When Google Assistant falsely activated, it allegedly recorded whatever was happening in the room -- private conversations, background noise, personal moments -- and transmitted that audio to Google's servers. In some cases, Google then sent those recordings to third-party contractors to review, all without the user's knowledge or consent.
The plaintiffs claim Google's conduct violated users' privacy rights, breached the privacy promises Google makes in its own Privacy Policy, and constituted an unlawful business practice.
Google denies all of the allegations. Google says it did nothing improper or unlawful. The court has not decided who is right. Both sides agreed to settle to avoid the costs and risks of a trial.
Google has agreed to pay $68,000,000 into a settlement fund.
There are two settlement classes, and you can be in one or both of them.
The Purchaser Settlement Class includes anyone who purchased a Google-Made Device in the United States or its territories between May 16, 2016 and the date of preliminary approval of the settlement. Google-Made Devices include Google Home, Google Home Mini, Google Home Max, Google Nest Hub, Google Nest Hub Max, and Google Pixel smartphones. If you bought any of these devices during the class period, you are in this class.
The Privacy Settlement Class includes anyone who was a Google Assistant user (or a member of a Google Assistant user's household) between May 16, 2016 and the date of preliminary approval, and whose communications were recorded or otherwise obtained by Google Assistant as a result of a false accept, or whose recordings were disclosed to any third-party review vendor. In plain terms: if Google Assistant turned on by itself and recorded you without you saying the trigger words, or if your recordings were sent to outside contractors for review, you are in this class.
You can be in both classes if you bought a Google-Made Device and were also recorded through a false accept. Being in both classes means more points and a larger payment.
A false accept is when Google Assistant activates and starts recording even though nobody said "OK Google" or "Hey Google." The device mistakenly detects its trigger words in normal conversation, background noise, or sounds from a TV or radio, and begins capturing audio. The lawsuit alleges that Google knew this was happening and continued collecting the recordings without adequately informing users.
If you have ever noticed your Google Home light up or your Pixel phone activate Google Assistant when you were not talking to it, that may have been a false accept. If you have ever seen Google Assistant show a transcription of something you said in a private conversation that you never intended to share with your device, that is exactly the kind of event this lawsuit is about.
The settlement covers Google-Made Devices, which are devices manufactured and sold by Google that come with Google Assistant pre-installed or available for download. These include Google Home (the original smart speaker), Google Home Mini, Google Home Max, Google Nest Hub (smart display), Google Nest Hub Max, and all Google Pixel smartphones.
The Privacy Settlement Class is broader -- it covers any Google Assistant Enabled Device, which includes not just Google-made products but also third-party devices with Google Assistant, such as non-Google smartphones, smart speakers, smart displays, and smart TVs with microphones. However, household devices without microphones (like thermostats, vacuums, and humidifiers) that do not have Google Assistant are not covered.
The $68 million fund will pay notice and administration costs, escrow fees, taxes, court-approved attorney fees (up to one-third of the fund), expenses (up to $1.6 million), and service awards (up to $10,000 per named plaintiff). The remaining net fund is distributed to class members who file valid claims.
Payments are calculated using a points system. Purchaser Settlement Class members receive 4 points for each eligible Google-Made Device included in their claim, up to a maximum of 3 devices (12 points max). Privacy Settlement Class members receive 1 point. If you are in both classes, your points are combined.
The net fund is divided proportionally based on total points across all claimants. The more points you have relative to the total, the larger your share. Exact payment amounts will not be known until the claims administrator determines how many people file and the total points.
To put it in perspective: if you bought 3 Google-Made Devices and were also recorded through a false accept, you would have 13 points (12 for devices + 1 for privacy). Someone who only bought 1 device would have 4 points. Your payment would be proportionally larger.
Submit your claim form online at GoogleAssistantPrivacyLitigation.com or by mail to the claims administrator. If you received an email about this settlement that included a Unique ID and PIN number, use those codes when filing your claim.
If you did not receive an email with a Unique ID and PIN, you can still submit a claim form as long as you are a settlement class member. You will need to provide information showing you purchased a Google-Made Device or that your Google account was associated with a Google Assistant Enabled Device during the class period.
Each claim must be individually signed under penalty of perjury. Parents or legal guardians must submit claims on behalf of minors (under 18). Bulk submissions by claims aggregators are not permitted.
The exact claim deadline has not yet been announced -- it will be set when the court grants preliminary approval. Check the settlement website for updates.
If you previously excluded yourself from the certified Purchaser Class by the September 9, 2024 deadline, you remain opted out of this settlement unless you take action to rejoin. To rejoin, simply submit a valid claim form by the claim deadline. Submitting a claim form will automatically cancel your previous opt-out and bring you back into the settlement classes.
If you do not submit a claim form, you will remain excluded and will not receive any payment, but you will also not release your claims against Google.
If there are funds remaining after the initial distribution, the claims administrator will send a second distribution to claimants who cashed their first payment. If a second distribution is not feasible, the remaining funds will go to a court-approved nonprofit organization. No remaining funds will be returned to Google.
