What the Case Was About

HALO Innovations, Inc., now known as HALO Dream, Inc., designs and sells infant sleep products including bassinets and sleep sacks. The class action alleged that two of its BassiNest Flex models had a design defect that allowed the sleep surface to tilt.

HALO denied the allegations and agreed to the settlement to avoid the cost and uncertainty of continued litigation. The court made no finding that the product was defective, and this was a private class action rather than a government recall proceeding.

There was no requirement to have experienced the alleged tilting and no injury requirement. Purchase of a covered model within the class period was the qualifying fact.

What the Settlement Paid

HALO funded a $1,500,000 settlement fund. Payment was calculated per class product:

• $30 per class product with valid proof of purchase.
• $10 per class product without proof of purchase.

Payments were subject to pro rata adjustment. Because the fund was fixed and the per-product amounts were set, the adjustment worked in claimants' favor when claim volume came in low — a light response could increase what each person received rather than dilute it.
