Plaintiffs alleged that A&W Root Beer and Cream Soda products labeled “Made With Aged Vanilla” were misleading because the vanilla flavor came in whole or in part from synthetic ethyl vanillin. A&W Concentrate Company and Keurig Dr Pepper denied wrongdoing and liability.
The settlement covered U.S. purchasers of qualifying regular, diet, or zero-sugar A&W Root Beer or Cream Soda labeled “Made With Aged Vanilla” from February 7, 2016 through June 2, 2023.
A valid claim without proof qualified for $5.50 per household. Documented purchases could increase the payment by 50 cents per qualifying unit, subject to a maximum of $25 and the settlement rules.
