What Was This Settlement About?

On November 29, 2024, Krispy Kreme discovered that hackers had gained unauthorized access to its systems and obtained the personal information of an unknown number of people. The exposed data includes some combination of names, dates of birth, Social Security numbers, and financial account access information. If you received a breach notification from Krispy Kreme, your data was likely compromised.

A class action lawsuit was filed, and Krispy Kreme agreed to pay $1,616,760 into a settlement fund. How Much Could You Get?

Class members had two options for cash payments and could choose one or the other, not both.

Option A — Documented Losses (up to $3,500): Those who experienced fraud, identity theft, or other out-of-pocket losses as a result of the breach could submit a claim with documentation (bank statements, receipts, phone records, correspondence, etc.) for reimbursement of up to $3,500 per person. Personal declarations alone did not count as documentation, but could be included to support other evidence. Expenses already covered by another source — including any credit monitoring offered by Krispy Kreme in the original breach notification — were not reimbursed.

Option B — No-Proof Cash Payment ($75 estimated): Those without documented losses, or who preferred not to submit documentation, could claim an estimated $75 cash payment with no proof required. This amount could increase or decrease depending on how many people filed claims.

If a class member submitted a claim for Option A but failed to provide adequate documentation, the claim was processed as Option B ($75 no-proof payment).

Free Credit Monitoring for Everyone

All settlement class members were entitled to one year of free credit monitoring regardless of whether they filed a claim form. The activation code was included on the postcard notice. The credit monitoring activates once the settlement receives final court approval.
