Philips Respironics, a medical-supply company owned by Philips, agreed to pay a minimum total of $479 million to compensate eligible consumers who paid for certain CPAP, BiPAP, and ventilator devices used for sleep apnea and breathing support. The settlement also included up to $15 million for "Device Replacement Awards" and $34 million for "Payer Awards." This was an economic-loss settlement only.
Approximately 10.8 million Continuous Positive Airway Pressure (CPAP) devices, Bi-Level Positive Airway Pressure (BiPAP) devices, ventilators, and other devices sold or distributed in the United States by Philips Respironics were subject to recall due to a foam defect. Philips medical devices used to treat obstructive sleep apnea and other breathing difficulties were associated with hundreds of reported deaths since April 2021, based on reporting from the U.S. Food and Drug Administration.
This settlement resolved economic-loss claims stemming from the purchase of affected Philips devices. It did not include claims for personal injury or medical monitoring, which were litigated and resolved separately (see below). Anyone using one of these devices should not stop treatment without consulting their physician.
You were a member of the Settlement Class if you were a person residing in the United States (including its Territories and the District of Columbia) who paid for, rented or leased, was prescribed, or reimbursed a payment for a qualifying recalled device. This included insurers, self-funded employers, and third-party payers. There were four categories of awards:
• Device Payment Award — for consumers who did not return their recalled device to Philips Respironics.
• Device Return Award — for consumers who registered and intended to return their recalled device.
• Device Replacement Award — for consumers who used their own money to purchase, lease, or rent a comparable replacement device.
• Payer Award — for those who reimbursed (in whole or in part) a payment for a recalled device.
Devices that had already been replaced by Philips were not eligible, even if the serial number otherwise appeared eligible.
Qualifying class members were eligible for a Device Payment Award for each recalled device they purchased, leased, or rented. The amount depended on the device model:

Class members could also qualify for a $100 Device Return Award for each recalled device returned, a Device Replacement Award for money spent to replace a recalled device on or after June 14, 2021 and before September 7, 2023, and a Payer Award from the $34 million payer fund.
The deadline to file an economic-loss claim was August 9, 2024, and the settlement is now closed to new claims. Approved claims have been processed and payments are being distributed. There is nothing left to file for the economic-loss settlement.
Personal-injury and medical-monitoring claims were handled separately from this economic-loss settlement. Philips reached a separate $1.1 billion personal-injury settlement in 2024. That program's registration deadline (January 31, 2025) and claim deadline (March 7, 2026) have also passed, and those claims are no longer being accepted. Payments on approved personal-injury claims began in 2026.
Is the Philips Respironics settlement still open?
No. The economic-loss settlement claim deadline (August 9, 2024) has passed, and the settlement is closed to new claims. Approved claims are being processed and payments are being distributed.
What did the economic-loss settlement cover?
The $479 million economic-loss settlement compensated people who paid for, leased, rented, or were prescribed certain recalled Philips Respironics CPAP, BiPAP, and ventilator devices. It included Device Payment Awards, a $100 Device Return Award, Device Replacement Awards, and Payer Awards. It did not cover personal-injury or medical-monitoring claims.
What about personal-injury claims?
Personal-injury and medical-monitoring claims were handled separately. Philips reached a separate $1.1 billion personal-injury settlement in 2024; its registration deadline (January 31, 2025) and claim deadline (March 7, 2026) have also passed, and those claims are no longer being accepted.
