What Is the Banana Republic & Gap Wage and Hour Settlement About?
You may be part of a $1,950,000 class action settlement if you worked as a non-exempt retail store employee for Banana Republic, LLC or The Gap, Inc. in California between October 27, 2022 and July 4, 2025.
The lawsuit, Weitz v. Banana Republic, LLC, was filed in the Los Angeles County Superior Court by former employees Laura Weitz and Laila Faiz. It accuses the companies of a series of California wage-and-hour violations, including failing to pay minimum and overtime wages, failing to provide compliant meal and rest periods, failing to provide accurate itemized wage statements, failing to reimburse business expenses, failing to pay all wages when due, and failing to pay sick pay. The plaintiffs also brought a representative claim for civil penalties under the California Private Attorneys General Act (PAGA).
Banana Republic and The Gap deny that they violated any laws or failed to pay any wages, and they admit no wrongdoing. The companies agreed to settle to avoid the cost and uncertainty of continued litigation. The Court has preliminarily approved the settlement and will decide whether to grant final approval at a hearing later this year.
Who Is in the Settlement Class?
You are a Class Member if you are or previously were employed by Banana Republic, LLC or The Gap, Inc. and were classified as a non-exempt retail store employee in California at any time during the Class Period.
The Class Period runs from October 27, 2022 through July 4, 2025. Based on the companies' records, the parties estimate there are about 9,600 class members who together worked roughly 199,411 pay periods during that time.
The same group also makes up the "Aggrieved Employees" for the PAGA portion of the settlement, which covers the identical period. If you worked even one day as a non-exempt retail store employee in California during the Class Period, you are included, and the Settlement Administrator already has your information from the companies' records.
How Much Can You Get?
The Gross Settlement Amount is $1,950,000. This is an all-in fund, and the companies pay their share of payroll taxes separately, on top of it. Before money is distributed to employees, the Court will consider deductions from the fund, including:
• Attorneys' fees of up to one-third of the fund (about $650,000) plus litigation costs up to $43,000
• Service awards of up to $10,000 each to the two plaintiffs who brought the case
• Settlement administration costs estimated not to exceed $55,000
• $50,000 in PAGA penalties, of which $37,500 goes to the State of California's Labor and Workforce Development Agency and $12,500 is distributed to Aggrieved Employees
After those deductions, the remaining Net Settlement Amount is estimated to be at least $1,132,000. That money is paid out to participating class members as Individual Class Payments.
Your payment is calculated pro rata. The administrator divides the Net Settlement Amount by the total number of pay periods worked by everyone in the class, then multiplies that figure by your own number of pay periods. Because the payout is tied to how long you worked during the Class Period, individual amounts vary — but across roughly 9,600 class members the average works out to somewhere around $115 to $120. Employees who worked more pay periods receive more.
If you also qualify as an Aggrieved Employee, your share of the $12,500 PAGA distribution is calculated the same way, based on the number of PAGA pay periods you worked, and is combined with your class payment into a single check.
Do I Need to File a Claim?
No. There is no claim form for this settlement.
If the Court grants final approval and you do not exclude yourself, the Settlement Administrator will automatically mail a check to the same address where your Class Notice was sent. You do not have to do anything to receive your payment.
The one thing worth doing is making sure the administrator has your current mailing address. If you have moved since you worked for Banana Republic or The Gap, contact the administrator through the official settlement website so your check reaches you. Settlement checks become void 180 days after they are issued, so cash or deposit yours promptly once it arrives.
What Are My Options?
Most class members will simply do nothing and receive a payment. You have a few other options if you want them:
• Do nothing. You stay in the settlement, receive your automatic payment, and give up the right to sue the companies over the wage claims covered by the settlement.
• Opt out. You can exclude yourself from the class portion by sending the administrator a written Request for Exclusion by July 21, 2026. If you opt out, you will not receive an Individual Class Payment, but you keep your right to pursue the wage claims on your own. You cannot opt out of the PAGA portion, and Aggrieved Employees are still paid their PAGA share even if they exclude themselves.
• Object. If you stay in the settlement but disagree with any part of it, you can submit a written objection by July 21, 2026, or appear at the Final Approval Hearing.
If you believe the company's records understate how many pay periods you worked, you can also submit a written challenge to the administrator by July 21, 2026, with supporting documents such as pay stubs.
When Will Payments Be Made?
The Final Approval Hearing is scheduled for November 9, 2026 at 10:00 a.m. in Department 11 of the Los Angeles County Superior Court, Spring Street Courthouse, before Judge Bruce Iwasaki. At that hearing the Court will decide whether to finally approve the settlement.
If the Court approves the settlement and no appeals are filed, the companies must fund the settlement within 35 days after it becomes final, and the administrator will mail checks within 14 days after that. Hearing dates can be moved, so check the official settlement website for the most current schedule.
